The BOP 3-Tier ‘Formulary’ Structure
Formulary: Is immediately available.
Non-Formulary: These require a lengthy pre-authorization process.
Not Available: Now it’s critical to request the treating physician review the BOP “similar equivalents”.
- If none is appropriate
- The treating physician (hopefully) has agreed to appear at the sentencing Hearing
- In addition to making a Video deposition, all before the Presentence Interview
- home confinement or
- The BOP makes the meds available
