New York state officials are scolding Hempstead Union Free School District, again.

In an order issued on Tuesday, the state threatened to oust school leaders if they fail to enroll students on the district's "wait list" and comply with investigations. After three families complained students were still waiting to start class, the state learned the district had up to 59 students on a wait list seeking to enroll in early February. The State Board of Education and the Office of the Attorney General launched an investigation of the district Feb. 5 and are demanding the district hand over a copy of the wait list and enroll those on it.

All public schools are required to provide access to students residing in their district, according to Supreme Court Decision Pyler v. Doe. District officials told the state all but 8 students on the list have now been enrolled, but the state has no way of verifying.

This is not the state's first demand on Hempstead this school year. After activists found about 34 Hispanic students were turned away from the district in November, the state ordered Hempstead to come up with a plan to properly enroll and place all students. The State Board of Education said Hempstead did submit a plan Dec. 3.

Hempstead has long been an under-performing district. Early in the school year, the district's Board of Education complained of overcrowding and strains on the district from an influx of new, largely Spanish-speaking students.

Hempstead's Superintendent and School Board President did not return requests for comment.
