In what scenarios does the False Claims Act not apply?
If you work for a federal contractor and feel that your employer has made false claims to the government, you may be eligible to file a lawsuit under the False Claims Act. Unfortunately, a number of exclusions to the False Claims Act might make it challenging to sue your employer. The term "public disclosure" refers to one of these exclusions. Under this exception, you cannot sue your employer for damages under the False Claims Act if you have previously made a public notice about the alleged fraud.

A reverse false claim happens when a business files a claim to acquire funds from the government and then submits a bogus invoice to be reimbursed. Under the False Claims Act, a whistleblower can file a lawsuit on behalf of the government to recover any losses sustained due to fraud. The False Claims Act was enacted by Congress in 1863 to prevent fraud in government contracting. It permits private citizens to launch lawsuits against firms that commit fraud against the government. A whistle blower is a person who discovers fraudulent behavior and discloses it to the government. A whistle blower can file these lawsuits. A whistleblower must be a current or former employee of the fraudulent company.
Before the conclusion of the government's investigation, the whistleblower's lawsuit cannot be filed. For their efforts, the whistleblower is rewarded. In some circumstances, the person who discovered the scam is eligible for a reward. In a reverse false claim, the government receives a claim and delivers a bogus invoice in response. In other instances, the government is aware that the invoice is false but does not file a report. The whistleblower is permitted to file a lawsuit against the firm and the government for their losses.
